1. Who can use Hunch

Hunch is intended for users in the United States who are at least 18 years old and legally able to enter into these Terms. You must meet these requirements to create an account or use the app. Do not use someone else’s identity or provide false account information.

These Terms apply to the Hunch app and hunchlog.com (together, the “Service”). When you agree to these Terms during registration or a purchase, you enter into an agreement with Memhold. If you do not agree, do not create an account or use the Service.

2. Friendly hunches, not cash wagers

Hunch lets friends record predictions, choose answers and friendly consequences, review results, and track their records. Hunch does not accept cash wagers, hold stakes, pay winnings, or process payments between users. A subscription buys access to app features; it is not a stake or an entry fee for a prize.

Do not use Hunch to organize cash betting, unlawful gambling, paid-entry prize pools, or transfers of money or cash equivalents based on an outcome. Any social consequence must be lawful, safe, voluntary, and agreed to by the people involved. Nobody is required to carry out an unwanted or unsafe activity.

Predictions, results, scores, and “receipts” are for entertainment. Memhold is not a party to your arrangements with friends, does not collect debts or enforce consequences, and does not guarantee that another user will agree with a result. Hunch records are not professional advice or independently verified statements of fact.

3. Your account and invitations

Keep your account information accurate and your sign-in credentials secure. You are responsible for activity you authorize through your account. Contact us promptly if you believe your account has been compromised.

Only invite people you know and have a legitimate reason to contact. Do not send unsolicited bulk invitations or upload another person’s private information without permission. You are responsible for the questions, answers, results, and other material you submit.

4. Subscriptions and Apple billing

Hunch offers subscriptions billed through Apple’s App Store. The purchase screen identifies the features included, price, billing period, and any trial or promotional terms before you subscribe. Apple processes payment using your Apple Account, subject to its applicable purchase terms.

If you choose an auto-renewing subscription, it renews for successive billing periods unless you cancel before renewal. Manage or cancel it in your Apple Account subscription settings. If a trial is offered, cancel at least 24 hours before the trial ends to avoid renewal. See Apple’s cancellation instructions.

Deleting the app or requesting deletion of your Hunch account does not by itself cancel an Apple subscription. Cancel through Apple as well. The expiration date shown by Apple determines when your subscription ends.

For purchases billed by Apple, request refunds through Apple’s refund service. Eligibility is governed by Apple’s policies and applicable law; these Terms do not take away mandatory refund or consumer rights.

Any subscription price changes will follow Apple’s applicable notice and consent requirements and the law. We will not charge for a new subscription without your purchase authorization.

5. Keep it safe and respectful

You must not use the Service to:

  • Harass, threaten, exploit, impersonate, or unlawfully discriminate against anyone.
  • Promote violence, self-harm, dangerous challenges, coerced activities, or illegal conduct.
  • Post unlawful content, intimate material without consent, or content that violates another person’s privacy or intellectual property rights.
  • Spam users, distribute malware, gain unauthorized access, circumvent access controls, or interfere with the Service.
  • Manipulate accounts or results through fraud, or collect other users’ information without authorization.

Report abuse, infringing content, or safety concerns to taylor.c.graham@gmail.com with enough detail for us to investigate. We may remove content or restrict accounts that violate these Terms.

6. Your content and our app

You retain ownership of content you submit. You give Memhold a nonexclusive, worldwide, royalty-free license to host, store, reproduce, and display that content only as needed to operate the Service, share it with its intended participants, address abuse, and comply with law. This does not give us permission to use your private hunches in advertisements without your separate permission.

You must have the rights needed to submit your content and grant that license. The license ends when the content is deleted from our systems, except to the extent necessary for permitted retention described in our Privacy Policy. Copies independently saved or shared by other users are outside our control.

Memhold and its licensors retain their rights in the app, website, branding, and other Service materials. Subject to these Terms and any applicable App Store license, you may use the Service for personal, noncommercial purposes. You may not copy, resell, or exploit the Service except with permission or as allowed by law.

7. Privacy

Our Privacy Policy explains the information used to provide Hunch, when it is shared, and how to request access or deletion. Other participants can see information you share with them and may save or redistribute it. Avoid posting sensitive personal information.

8. Ending your use of Hunch

You may stop using Hunch at any time and request account deletion by contacting taylor.c.graham@gmail.com. Subscription cancellation is handled separately through Apple.

We may suspend or end access when reasonably necessary to address a violation of these Terms, fraud, a security or safety risk, or a legal requirement. Where practical and lawful, we will provide notice and an opportunity to resolve the issue. You may contact us if you believe a restriction was a mistake.

We may change or discontinue features. If a change materially affects a paid subscription, we will provide appropriate notice and honor applicable consumer rights and Apple’s purchase rules. We do not promise permanent storage of every hunch or uninterrupted availability.

9. Availability and responsibility

To the extent permitted by law, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not guarantee error-free operation, uninterrupted access, or the accuracy of user content and results.

To the extent permitted by law, Memhold is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from use of the Service. Memhold’s total liability for claims relating to the Service is limited to the greater of $100 or the amount you paid for Hunch subscriptions during the 12 months before the event giving rise to the claim.

These limitations do not exclude or limit liability for fraud, willful misconduct, gross negligence, or any liability that cannot legally be excluded or limited. Any mandatory consumer protections continue to apply.

10. Governing law and disputes

New York law governs these Terms, without regard to conflict-of-law rules, except where applicable law requires otherwise. This choice does not deprive you of nonwaivable protections under the laws that apply to you.

Please contact us about a concern so we can try to resolve it. These Terms do not require binding arbitration or waive your right to bring an eligible claim in small claims court. Disputes may be brought in a court with proper jurisdiction.

11. Updates and contact

We may update these Terms as Hunch changes. We will post the revised version and update the date above. For material changes, we will provide additional notice before they take effect and obtain agreement when required by law. Changes do not apply retroactively to an existing dispute.

If a provision is unenforceable, the remaining provisions continue to apply. These Terms, together with applicable purchase terms, form the agreement about your use of the Service.
